Wielicka 42\/103, 30-552 Krak\u00f3w, a registered association entered in the register of associations and the register of entrepreneurs of the National Court Register, maintained by the District Court for Krak\u00f3w \u2013 \u015ar\u00f3dmie\u015bcie in Krak\u00f3w, XI Commercial Division of the KRS, under number: 0000110651, NIP: 6821001920, REGON: 350183699 \u2013 the entity managing the airport area in Pobiednik Wielki.<\/li>\n \t<li aria-level=\"1\">Podhale Aero Club \u2013 AEROKLUB PODHALA\u0143SKI, with its registered office in \u0141ososina Dolna, \u0141ososina Dolna Airport, 33-314 \u0141ososina Dolna, a registered association entered in the register of associations and the register of entrepreneurs of the National Court Register, maintained by the District Court for Krak\u00f3w \u2013 \u015ar\u00f3dmie\u015bcie in Krak\u00f3w, XI Commercial Division of the KRS, under number: 0000039831, NIP: 7341028026, REGON: 490421041 \u2013 the entity managing the airport area in \u0141ososina Dolna.<\/li>\n \t<li aria-level=\"1\">Customer \u2013 a natural person with full legal capacity, and in cases provided for by generally applicable law also a natural person with limited legal capacity, for whom the Service Provider provides services specified in these Terms of Service (in the case of persons without full legal capacity, written consent of a statutory representative is required to use the services).<\/li>\n \t<li aria-level=\"1\">Civil Code \u2013 the Act of 23 April 1964 (Journal of Laws No. 16, item 93, as amended);<\/li>\n \t<li aria-level=\"1\">Consumer \u2013 an adult natural person with full legal capacity, making a purchase from the Seller not directly related to their business or professional activity.<\/li>\n \t<li aria-level=\"1\">Recipient \u2013 a person who, after making a reservation and presenting the Voucher, is entitled to use the services provided by the Service Provider;<\/li>\n \t<li aria-level=\"1\">Product \u2013 services or vouchers for services, being the subject of the Seller&#8217;s offer;<\/li>\n \t<li aria-level=\"1\">Validity Period \u2013 applies to the service as well as the voucher and means the time within which the service must actually be performed. After this period expires, performance of the service is not possible. This period is stated on the voucher or in the order confirmation.<\/li>\n \t<li aria-level=\"1\">Reservation \u2013 the customer&#8217;s\/recipient&#8217;s submission of a preferred date for service performance by independently completing the reservation form. The submitted date must be confirmed by the Service Provider electronically or by phone.<\/li>\n \t<li aria-level=\"1\">Terms of Service \u2013 these terms of service, available at <a href=\"https:\/\/www.kraksky.pl\/\">www.kraksky.pl<\/a>.<\/li>\n \t<li aria-level=\"1\">Seller and Service Provider \u2013 STOWARZYSZENIE SKYDIVE KRAK\u00d3W, W\u0119grzce Wielkie 616, 32-002 W\u0119grzce Wielkie, NIP: 6832121243<\/li>\n \t<li aria-level=\"1\">Sales Agreement \u2013 a Sales Agreement for products concluded between the Seller and the Customer;<\/li>\n \t<li aria-level=\"1\">Service User \u2013 a natural person with full legal capacity, and in cases provided for by generally applicable law also a natural person with limited legal capacity; a legal person; or an organizational unit without legal personality to which the law grants legal capacity; \u2013 who uses or intends to use the Electronic Service.<\/li>\n \t<li aria-level=\"1\">Voucher \u2013 a document confirming the conclusion of the agreement and entitling its bearer (recipient) to use the services provided by the KRAKSKY Parachute School specified in this document, with an individual identification number. The Voucher may include a dedication for the recipient (of a maximum length of 100 characters).<\/li>\n \t<li aria-level=\"1\">Order \u2013 a declaration of intent by the Customer, directly aimed at concluding a Sales Agreement, specifying in particular the type and quantity of products.<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>General Provisions<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">These Terms of Service have been drawn up on the basis of the laws in force in the Republic of Poland.<\/li>\n \t<li aria-level=\"1\">These Terms of Service set out the general conditions and manner of providing electronic services and sales conducted via the website <a href=\"https:\/\/www.kraksky.pl\/\">www.kraksky.pl<\/a>.<\/li>\n \t<li aria-level=\"1\">These Terms of Service are continuously available on the website <a href=\"https:\/\/www.kraksky.pl\/\">www.kraksky.pl<\/a> or its subpages, in a manner enabling their retrieval, reproduction and preservation of their content by printing or saving to a medium at any time.<\/li>\n \t<li aria-level=\"1\">A condition for beginning to use the website is reading these Terms of Service and fully accepting them. Reading and accepting these Terms of Service is deemed equivalent to the Entrepreneur providing the consumer with the information referred to in Article 12 of the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827); this information is contained in the following points of the terms of service.<\/li>\n \t<li aria-level=\"1\">Use of the website is possible provided that the IT system used by the Customer meets the following minimum technical requirements: a computer or mobile device with Internet access, access to electronic mail, a web browser (one of the following): Firefox, Chrome, Safari, Internet Explorer, Opera, updated to the latest version, with JavaScript support enabled.<\/li>\n \t<li aria-level=\"1\">The Customer is obliged to:<\/li>\n<\/ol>\n<ol>\n \t<li aria-level=\"1\">provide only truthful, current and all necessary data when placing an order within the website, as well as updating it without delay.<\/li>\n \t<li aria-level=\"1\">use the services provided by the Service Provider in a manner that does not disrupt the functioning of the Service Provider, the website and other Customers;<\/li>\n \t<li aria-level=\"1\">use the services provided by the Service Provider in a manner consistent with the law and the provisions of the Terms of Service.<\/li>\n<\/ol>\n<ol>\n \t<li aria-level=\"1\">From 1 January 2021, the provisions concerning consumers set out in these terms of service and the Consumer Rights Act (right of withdrawal, liability under warranty, unfair contract terms) apply to contracts concluded from that date also to Customers who are natural persons concluding a contract directly related to their business activity, where the content of those contracts indicates that they are not of a professional nature for them. To determine whether such a customer has consumer rights in given circumstances, it should be verified whether the concluded contract is of a professional nature based on that entrepreneur&#8217;s entry in the Central Register and Information on Economic Activity of the Republic of Poland.<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>Electronically Provided Services<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">Services are provided by the Service Provider free of charge, 24 hours a day, 7 days a week.<\/li>\n \t<li aria-level=\"1\">The Service Provider provides the following Electronic Services to Service Users via the Website:<\/li>\n<\/ol>\n<ol>\n \t<li aria-level=\"1\">Placing orders and concluding Sales Agreements, on the terms set out in these Terms of Service;<\/li>\n<\/ol>\n<ol>\n \t<li aria-level=\"1\">The agreement for the provision of the Electronic Service consisting of enabling the placement of an Order on the Website is concluded for a definite period of time and is terminated upon the placement of the Order or upon the Service User ceasing to place it.<\/li>\n \t<li aria-level=\"1\">The Service Provider may at any time terminate the Service Agreement with the Service User with a 14-day notice period for important reasons, understood as a change in the legal provisions regulating the provision of electronic services by the Seller affecting the mutual rights and obligations set out in the agreement concluded between the Service User\/Customer and the Service Provider, or a change in the scope or provision of services to which the provisions of the Terms of Service apply.<\/li>\n \t<li aria-level=\"1\">In the event of a breach of the provisions of these Terms of Service by the Service User\/Customer, the Service Provider, after a prior unsuccessful request to cease or remedy the breaches, with a reasonable deadline set, may terminate the Service agreement with a 14-day notice period.<\/li>\n \t<li aria-level=\"1\">Termination of the Account service agreement by either Party, as well as termination of the Account service agreement by mutual consent of both Parties, does not affect the rights acquired by the Parties prior to its termination.<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>Sales Agreement<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">The information presented on the Website constitutes only an invitation to conclude an agreement within the meaning of Article 71 of the Civil Code, directed by the Seller to Customers, and not an offer within the meaning of the provisions of the Civil Code.<\/li>\n \t<li aria-level=\"1\">The price of a Product shown on the Website is given in Polish zloty and includes taxes. The Customer is informed of the total price including taxes for the service being the subject of the order, as well as of delivery costs (including transport, delivery and postal service charges) and other costs, and where the amount of these charges cannot be determined \u2013 of the obligation to pay them, on the website pages during the ordering process, including at the moment when the Customer expresses their will to be bound by the agreement.<\/li>\n \t<li aria-level=\"1\">Orders can be placed 24 hours a day. A condition for placing an Order for products is completing the order form and having an active email account.<\/li>\n \t<li aria-level=\"1\">To place an order, you must select the Products available for sale, specify their quantity, select any additional parameters required in the form (select the service, provide your necessary data, provide other information), and accept these Terms of Service.<\/li>\n \t<li aria-level=\"1\">The total value and final price of the order is shown in the payment summary and is visible before the final confirmation of the order. The customer then selects a payment method.<\/li>\n \t<li aria-level=\"1\">When placing an Order via the Order form available on the website, the Order is submitted to the Seller by the Customer in electronic form and constitutes an offer to conclude a Sales Agreement for the Products being the subject of the Order. An offer submitted in electronic form is binding on the Customer if the Seller sends a confirmation of acceptance of the Order to the Customer&#8217;s email address, which constitutes the Seller&#8217;s declaration of acceptance of the Customer&#8217;s offer, and upon its receipt by the Customer the Sales Agreement is concluded.<\/li>\n \t<li aria-level=\"1\">The Customer is obliged to pay the price for the purchased Product.<\/li>\n \t<li aria-level=\"1\">A condition for activating the service is making payment in the amount of the order placed.<\/li>\n \t<li aria-level=\"1\">With respect to vouchers, they are in no case exchangeable for money; they only entitle the holder to use the service, subject to distance purchases regulated by the relevant Act.<\/li>\n \t<li aria-level=\"1\">The Voucher is delivered to the customer according to their choice in the following manner:<\/li>\n<\/ol>\n<ol>\n \t<li aria-level=\"1\">by email as an eVoucher to the email address indicated by the customer, immediately after placing the order,<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>Payments<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">The Customer may choose the following payment methods:<\/li>\n<\/ol>\n<ol>\n \t<li aria-level=\"1\">electronic payment including payment cards (in this case, the performance of the Order will commence after the Seller sends the Customer a confirmation of acceptance of the Order and after the Seller receives information from the payment agent&#8217;s system about the Customer&#8217;s payment);<\/li>\n<\/ol>\n<ol>\n \t<li aria-level=\"1\">The operator of electronic payments is PayU S.A. with its registered office in Pozna\u0144, 60-166 Pozna\u0144, ul. Grunwaldzka 186.<\/li>\n \t<li aria-level=\"1\">The operator of electronic payments is also PayPal (PayPal (Europe) S.\u00e0 r.l. &amp; Cie, S.C.A., 5th floor, 22-24 Boulevard Royal, 2449 Luxembourg).<\/li>\n \t<li aria-level=\"1\">When making an electronic payment, the User will be informed directly before making it of the amount in which the payment should be made, of the possible ways of making it, and of the data of the operator processing the payments, if such possibility exists within a given service. The detailed terms and conditions for making payments via operators processing electronic payments are available on the website of the respective operator.<\/li>\n \t<li aria-level=\"1\">When making a payment via an electronic payment operator, the User should follow the instructions provided by the electronic payment operator in order to make the payment.<\/li>\n \t<li aria-level=\"1\">The Customer authorizes the Seller to issue a VAT invoice without the recipient&#8217;s signature in electronic form (or another bill documenting the sale in electronic form).<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>Reservation and Service Performance Conditions<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">The Customer\/Recipient may use the purchased service\/voucher during the validity period in the months from <u>April to October<\/u>. In order to use the service \u2013 the customer\/recipient must make a reservation before the expiry of the validity period, in order to determine the details of service performance such as: place and time of performance, customer\/recipient data and all other necessary details.<\/li>\n \t<li aria-level=\"1\">In order to change the date of service\/voucher performance to another date \u2013 the customer\/recipient is obliged to contact the KRAKSKY Parachute School no later than three business days before the agreed performance date. Such a change may be made a maximum of 2 times, with the proviso that after the validity period has expired, such a change is no longer possible.<\/li>\n \t<li aria-level=\"1\">The KRAKSKY Parachute School undertakes to make every effort to ensure that the service\/voucher is performed at a date most convenient for the customer\/recipient; however, it is unable to guarantee service performance on every date indicated by the customer\/recipient.<\/li>\n \t<li aria-level=\"1\">Failure to use the service\/voucher within the validity period, as well as failure to make a reservation before the expiry of the validity period, results in the expiry of all rights associated with the agreement, in particular it means that the service\/voucher can no longer be used by the customer\/recipient, and no claims are due to the customer\/recipient on this account, in particular a claim for a refund of the price paid.<\/li>\n \t<li aria-level=\"1\">The Customer\/Recipient is obliged to follow the instructions, recommendations, regulations, guidelines and orders of persons representing the KRAKSKY Parachute School.<\/li>\n \t<li aria-level=\"1\">The KRAKSKY Parachute School may refuse to perform the service\/voucher if the customer\/recipient does not comply with instructions, or if they are under the influence of alcohol, intoxicating substances, or due to the health condition or psychophysical state of the customer\/recipient.<\/li>\n \t<li aria-level=\"1\">The KRAKSKY Parachute School may also require the customer\/recipient to sign an additional declaration related to health protection or safety during the performance of the service\/voucher. Refusal to sign the aforementioned document constitutes grounds for the KRAKSKY Parachute School to refuse performance of the service\/voucher.<\/li>\n \t<li aria-level=\"1\">The Customer\/Recipient should arrive at the place of service\/voucher performance at least 15 minutes before the time agreed during the reservation, unless earlier arrival is required.<\/li>\n \t<li aria-level=\"1\">Failure of the customer\/recipient to appear at the place of service\/voucher performance or being more than 15 minutes late relative to the time agreed during the reservation results in the complete forfeiture of entitlement to use the service\/voucher, regardless of the reasons, including in the case of being late or failing to appear at the place of performance due to circumstances beyond their control \u2013 without a refund from the KRAKSKY Parachute School.<\/li>\n \t<li aria-level=\"1\">The scheduled jump time for the customer may change due to reasons beyond the control of the KRAKSKY Parachute School; therefore, the time spent at the airport and waiting for the jump may be extended.<\/li>\n \t<li aria-level=\"1\">Performance of the service\/voucher depends on weather conditions; therefore, the KRAKSKY Parachute School may refuse to perform the service\/voucher in a situation where, in its assessment, doing so could endanger the health or life of the customer\/recipient. In such a case, the customer\/recipient may arrange a new date for service\/voucher performance. In the situation described above of refusal to perform the service\/voucher, the KRAKSKY Parachute School does not cover the costs incurred by the customer\/recipient in connection with the service\/voucher performance, in particular costs such as transport and accommodation.<\/li>\n \t<li aria-level=\"1\">In the event that the service\/voucher was not performed due to technical reasons beyond the control of the KRAKSKY Parachute School, such as in particular machine and equipment failures, weather changes, the KRAKSKY Parachute School does not cover the costs incurred by the customer\/recipient in connection with the service\/voucher performance, in particular costs such as transport and accommodation.<\/li>\n<\/ol>\n<ol>\n \t<li aria-level=\"1\">In the case of minors or persons without full civil legal capacity, performance of the service\/voucher involving risk to the health or life of the customer\/recipient requires written consent of the legal guardians of the minor or of the person without full civil legal capacity, given under pain of invalidity, and the presence of at least one guardian at the place where the service\/voucher is being performed. Absence of the consent document or absence of one of the guardians constitutes grounds for refusing to perform the service\/voucher.<\/li>\n \t<li aria-level=\"1\">In the event of refusal by the KRAKSKY Parachute School to perform the service\/voucher in connection with the cases described above, the customer\/recipient is not entitled to any claims, in particular claims regarding re-performance of the service\/voucher, refunds, or other costs incurred, such as transport and accommodation costs.<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>Place of Service Provision and Conditions<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">The KRAKSKY Parachute School provides services at the Krak\u00f3w Aero Club at the airport in Pobiednik Wielki and at the Podhale Aero Club at the \u0141ososina Dolna airport, where parachute training and parachute jumps are conducted.<\/li>\n \t<li aria-level=\"1\">The Aero Club premises include areas designated for the management of the KRAKSKY Parachute School, crew, jumpers and accompanying persons.<\/li>\n \t<li aria-level=\"1\">The training participant (Customer\/Recipient) is entitled to: use the infrastructure and parachute equipment of the KRAKSKY Parachute School, access the Jump and Drop Regulations, Training Instructions and training programs of the KRAKSKY Parachute School, address matters relating to training to instructors or to the Head of Training, refuse to perform a training jump without giving reasons (with the awareness of the complete forfeiture of entitlement to use the service\/voucher, regardless of the reasons for refusal \u2013 without a refund from the KRAKSKY Parachute School).<\/li>\n \t<li aria-level=\"1\">The training participant (Customer\/Recipient) is obliged to: follow the instructor&#8217;s instructions, participate in theoretical and practical classes, inform others of any deterioration in wellbeing or health condition, inform the lead instructor of any doubts or uncertainties regarding the training.<\/li>\n \t<li aria-level=\"1\">At the Aero Club premises, the KRAKSKY Parachute School provides services related to performing training jumps for PJ qualification certificates, jumps for persons holding PJ qualification certificates, and tandem jumps with passengers.<\/li>\n \t<li aria-level=\"1\">There is a complete ban on entry to the aircraft taxiing area and the jumpers&#8217; landing zone for persons not connected with aviation activities.<\/li>\n \t<li aria-level=\"1\">The jump master designates for all jumpers the crossing point from the safety zone to the loading point.<\/li>\n \t<li aria-level=\"1\">There is a complete ban on consuming alcoholic beverages and taking intoxicating substances on the premises of Pobiednik Wielki airport and \u0141ososina Dolna airport.<\/li>\n \t<li aria-level=\"1\">Particular caution must be exercised when crossing from the safety zone to the aircraft.<\/li>\n \t<li aria-level=\"1\">Only persons listed on the loading manifest may board the aircraft, and in the case of student jumpers and tandem passengers \u2013 additionally with the signature on the loading list of the supervising person.<\/li>\n \t<li aria-level=\"1\">The jump participant (Customer\/Recipient) is obliged to comply with aviation regulations in force in the Republic of Poland.<\/li>\n \t<li aria-level=\"1\">Jumps may only be performed using parachutes approved by the Manifest of the KRAKSKY Parachute School.<\/li>\n \t<li aria-level=\"1\">A parachutist holding a PJ qualification certificate is obliged to make their parachute set available for technical inspection upon request by any duty personnel of the KRAKSKY Parachute School.<\/li>\n \t<li aria-level=\"1\">The following order of exit from the aircraft applies: FS groups (from largest to smallest), FF groups (from largest to smallest), AFF teams, tandem teams, jumpers performing jumps in wingsuit and track suits, CF teams; exceptions to this rule are directed by the jump master.<\/li>\n \t<li aria-level=\"1\">Height separation above the aircraft runway and landing strip applies; no jumper shall be above the strip below 400 meters above ground.<\/li>\n \t<li aria-level=\"1\">Landing of parachutists and student jumpers is permitted only in the direction required, as communicated before the jump by the jump master.<\/li>\n \t<li aria-level=\"1\">Landing on the runway and taxiways is prohibited; in the event of an emergency landing on these elements, they must be vacated immediately with attention to air traffic.<\/li>\n \t<li aria-level=\"1\">Crossing the runway is permitted only after verifying that no aviation operation is taking place on it.<\/li>\n \t<li aria-level=\"1\">Only persons authorized to do so and belonging to the staff of the KRAKSKY Parachute School under an agreement with the KRAKSKY Parachute School are permitted to pack the parachutes belonging to the KRAKSKY Parachute School&#8217;s equipment.<\/li>\n \t<li aria-level=\"1\">Particular attention must be paid to air traffic when moving around the airport.<\/li>\n \t<li aria-level=\"1\">It is prohibited to cross the loading line or run toward the aircraft while it is taxiing.<\/li>\n \t<li aria-level=\"1\">Only persons planned for a jump by the KRAKSKY Parachute School &#8220;Manifest&#8221; are included on the loading list, after providing all required data, presenting required documents and signing required declarations.<\/li>\n \t<li aria-level=\"1\">A jumper&#8217;s basic equipment consists of a parachute set with AAD, an altimeter and a knife; for FS and FF jumps also a helmet: a parachutist may have additional equipment accepted by the jump master that does not endanger their safety.<\/li>\n \t<li aria-level=\"1\">In disputed situations, the final decision is made by the jump master.<\/li>\n \t<li aria-level=\"1\">Failure to comply with the above points of the KRAKSKY Parachute School&#8217;s Terms of Service will result in immediate suspension from jumping or removal from the Aero Club premises.<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>Right of Withdrawal and Its Exclusion<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">Within 14 days of placing the order (service\/voucher), if the service\/voucher has not yet been performed or reserved, the customer may withdraw from the agreement and cancel the service\/voucher without giving reasons, notifying the KRAKSKY Parachute School in writing at the company&#8217;s address or at <a href=\"mailto:rezerwacje@kraksky.pl\">rezerwacje@kraksky.pl<\/a>.<\/li>\n \t<li aria-level=\"1\">By choosing to reserve, exchange or use the service\/voucher \u2013 the customer\/recipient agrees to the loss of the right of withdrawal before the expiry of the 14-day period described above.<\/li>\n \t<li aria-level=\"1\">In the event of withdrawal from the agreement by the customer, the agreement is deemed not to have been concluded, and the amount paid for the service\/voucher will be refunded to the customer&#8217;s bank account or in another manner indicated by the customer and accepted by the KRAKSKY Parachute School.<\/li>\n \t<li aria-level=\"1\">The right of withdrawal from a distance contract does not apply to the customer if the KRAKSKY Parachute School has fully performed the service with the customer&#8217;s express consent, and the customer was informed before the commencement of the service that upon completion of the service by the KRAKSKY Parachute School they would lose the right of withdrawal.<\/li>\n \t<li aria-level=\"1\">The KRAKSKY Parachute School reserves the right to withdraw from the agreement concluded with the customer in a situation where performance of the service\/voucher proves impossible (e.g. force majeure) \u2013 in such case the customer is refunded the full amount paid, unless they decide to accept the alternative offer presented to them by the KRAKSKY Parachute School.<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>Complaints Procedure<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">The Seller has a sufficiently formalized complaints procedure and handles complaints in accordance with this procedure.<\/li>\n \t<li aria-level=\"1\">The Customer has the right to file a complaint by notifying the KRAKSKY Parachute School in writing at the company&#8217;s address or at rezerwacje@kraksky.pl. In the case of a complaint regarding non-performance or improper performance of the service\/voucher, the customer\/recipient submits the complaint no later than 7 days from the date of performance of the service\/voucher or from the date on which it was supposed to be performed.<\/li>\n \t<li aria-level=\"1\">The Seller undertakes to consider each complaint within 14 days. In the event of deficiencies in the complaint, the Seller will request the Customer to complete it to the necessary extent without delay, no later than within 7 days from the date of receipt of the request by the Customer.<\/li>\n<\/ol>\n<ul>\n \t<li aria-level=\"1\"><b>Out-of-Court Methods of Handling Complaints and Claims<\/b><\/li>\n<\/ul>\n<ol>\n \t<li aria-level=\"1\">The Seller informs about the possibility of using out-of-court methods of handling complaints and pursuing claims.
